ACTION ABOUT SCRIP.
Chatield v Blackman.
Mr P. Halse Rogers, instructed bv Messrs Lambton and Milford, appeared for the plaintiff. The defendant did not appear. This was an action brought by Robert Percy CHATFIELD, accountant, against Emma May Blackman, for the return of certaln scrip certificates in the Grand Cccanyon Park Estate Ltd., and damages for their detention. Plaintiff's case was that, in August, 1913, the company referred to was formed and registered, plaintiff being managing director, and defendant becoming the holder of certain shares, and at various times he advanced her money to the total amount of £95. for which he received scrip as security. Certificates representing her shares were issued to defendant and in 1914 a proposal was made that plaintiff should buy the shares, pay defendant £100, and release her fiom all her liabilities to hlm. This proposal was accepted, and an agreement was drawn up and signed by the parties. Plaintiff paid defendant the £100 and afterwards sent the scrip to her husband to have the necessary transfer warrants made out, but though he had repeatedly demanded a return of the scrip, defendant had not handed them back. Plaintiff therefore sued for the return of the scrip or £100 damages for thelr detention.
Verdict for the plaintiff, with damages £100, but to be reduced to 1s upon the scrip being returned to the plaintiff.
