Description: Between (a) Charles Hewitt Smith of Chichester, esq. (b) Charles Peckham Peckham of Chichester, esq. (only child of (a) by Mary, his late w. formerly Mary Peckham, dec'd.) (c) Rt. Rev. Robert James [Carr] Lord Bishop of Chichester (d) Sibella Jane Carr (one of the daus. of (c) by Nancy, his w.) and (e) Ven. Charles Webber, Archdeacon of Chichester and James Martin Lloyd of Lancing, esq.

Recites: (1) that a marriage is intended between (b) and (d)

(2) Lease and release, 7/8 December 1826 between (a), (b) and (e) of freehold hereditaments in Birdham and Poling and copyhold hereditaments held of the Manor of South Bersted, in trust to (e) to sell, in order to pay off a mortgage of £6000 and interest on the said hereditaments.

(5) that all monies to which (d) might become entitled should be assigned to (e) in trust

(I) Assignment of £2100 4% Bank annuities and any other share of £10,500 4% Bank annuities to which (d) becomes entitled to (e) on trust.

(II) The money arising from the sales of freehold and copyhold [see recital 2] to be invested in government securities.

The interest of (I) to go to (b) for his life and on his death to (d) for her life. If (d) should survive (b) and remarry then only half interest to be payable. If the interest devised from (II) should exceed £500 p. a., then the excess over £500 to be paid to (a) for his life, on his death the excess to be treated in the same manner as the initial £500. On the death of the survivor of (b) and (d) the interest to go to the children of (b) on the body of (d).
